Opalesque Exclusive: Clifford Chance says foreign investors need to be more cautious when investing in Japanese companies Clifford Chance highlights in a Client Briefing entitled "Revision of Regulations of Foreign Investments in Japan under the Foreign Exchange and Foreign Trade Law" after the recent law changes:

Regulations under the Foreign Exchange and Foreign Trade Law (FIEL) were revised on 28 September 2007. The revisions include the following: (i) the scope of industries which require prior notification under the Regulations was widened, (ii) the scope of the transaction covered by the Regulations was revised and (iii) there was a change in administrative procedures. As a result of the revisions, foreign investors need to be more cautious when they propose investing in Japanese companies and more notifications under the Regulations can be expected.
